Evidence Watcher Subscription Terms

These Subscription Terms supplement Evidence Watcher's Terms of Service and apply to paid subscriptions, renewals, cancellations, refunds, billing changes, taxes, and seat changes for the Evidence Watcher service.

"Evidence Watcher," "we," "us," and "our" refer to SOUTHBYTE LABS LTD. "You" and "your" refer to the individual or organization purchasing or using a paid subscription.

1. Subscription Plans

Evidence Watcher may offer monthly, annual, or other subscription plans. Plan details, billing period, included features, seat limits, and pricing are shown at checkout, in the billing flow, in an order form, or in a separate written agreement.

2. Automatic Renewal

Unless otherwise stated at checkout or in a separate written agreement, subscriptions renew automatically unless canceled before the renewal date.

By purchasing a subscription, you authorize Evidence Watcher and its payment processor to charge your selected payment method for recurring subscription fees, applicable taxes, seat changes, and other charges disclosed at checkout or in the billing flow.

3. Billing Period

The billing period is monthly or annual unless a different period is shown at checkout, in an order form, or in a separate written agreement.

Subscription fees are generally billed in advance for the applicable billing period.

4. Price and Checkout Disclosures

The price for your subscription will be shown at checkout before you complete the purchase. Checkout may also show the billing period, renewal terms, taxes, seat count, plan limits, and cancellation method.

If there is a conflict between these Subscription Terms and a checkout page, order form, or separate written agreement, the more specific checkout page, order form, or separate written agreement controls for that subscription.

5. Cancellation

You may cancel future renewals through account settings, the available billing or customer portal, or by contacting Evidence Watcher at info@evidencewatcher.com.

Cancellation stops future renewal charges, but it does not refund the current billing period or any past billing period unless required by law or expressly stated by Evidence Watcher.

You are responsible for canceling before the renewal date if you do not want your subscription to renew.

6. Access After Cancellation

If you cancel a paid subscription, access to paid features generally continues until the end of the then-current paid term, unless your account is suspended or terminated for non-payment, misuse, legal compliance, or violation of the Terms of Service.

After the paid term ends, Evidence Watcher may downgrade, restrict, suspend, or terminate access to paid features.

7. Refunds

Fees are non-refundable except where required by law or expressly stated by Evidence Watcher.

Evidence Watcher does not automatically provide prorated refunds or credits for partial billing periods, unused seats, unused features, downgrade requests, or cancellation during a paid term.

Evidence Watcher may consider refund requests for billing errors, duplicate charges, technical issues that materially prevent access to the paid Service, or other circumstances Evidence Watcher determines appropriate.

To request a refund review, contact info@evidencewatcher.com with your account email address, date of charge, amount charged, and reason for the request.

8. Pricing Changes

Evidence Watcher may change subscription pricing, plan features, seat pricing, usage limits, or billing terms from time to time.

For active paid subscriptions, Evidence Watcher will provide reasonable advance notice of material price increases unless the change is required by law, caused by tax changes, reflects a change you requested, or is otherwise permitted by applicable law.

If you do not agree to a price change, you may cancel before the change takes effect.

9. Failed Payments

If a payment fails, is disputed, is reversed, is overdue, or cannot be processed, Evidence Watcher may retry the charge, request updated payment information, suspend or limit access, downgrade the account, cancel the subscription, or terminate access as permitted by law and the Terms of Service.

You remain responsible for unpaid amounts, taxes, and charges incurred before cancellation or termination.

10. Taxes

Taxes are separate unless stated otherwise at checkout, in an order form, or in a separate written agreement.

You are responsible for applicable taxes, duties, levies, or similar governmental assessments associated with your subscription, except for taxes based on Evidence Watcher's income.

Where required, Evidence Watcher or its payment processor may calculate, collect, and remit taxes.

11. Seat and User Changes

If you add, remove, or change seats, users, or plan limits, Evidence Watcher may charge or credit those changes immediately, prorate them for the remaining billing period, apply them at the next renewal, or handle them as otherwise shown in the billing flow, checkout page, order form, or separate written agreement.

Unless otherwise stated, removing a seat or user does not automatically entitle you to a refund or credit for the current billing period.

12. Applicable Law

Nothing in these Subscription Terms limits any cancellation, refund, withdrawal, cooling-off, or subscription rights that cannot be waived under applicable law.
